General Policy
All goods supplied are covered by such warranty as is specified below and supplied subject to the product standards detailed by Pacific Valves and shall apply to the sale of the goods.
The buyer shall immediately notify Pacific Valves International (PVI) in writing upon discovery of any defect in the goods. The buyer shall not carry out any remedial work to alleged defective goods without first obtaining the written consent of PVI to do so.
The only conditions and warranties which are binding on PVI in respect of the state, quality or condition of the goods supplied by it to the buyer are those imposed and required to be binding by this agreement and any amendment or re-enactment thereof, and to the extent permitted thereby. The liability, if any, of PVI arising from the breach of such conditions or warranties shall at PVI's option be limited to and completely discharged by –
The replacement of the goods or resupply of same by PVI, or
* The repair of the goods; or
* The payment of the cost of replacement of the goods; or
* The payment of the cost of repair of the goods
This is to be at the selection of PVI
Warranty Terms
(a) Any warranty, condition, description or representation whether express or implied as to the description, state, quality, merchantability or fitness of the goods for the purpose for which they are provided is hereby excluded to the extent that the relevant laws of Hong Kong permit.
(b) If any Trade Practices Act or any other legislation implies a condition or warranty into this agreement in respect of goods supplied, and the Supplier’s liability for breach of that condition or warranty may not be excluded but may be limited, the Supplier’s liability for any breach of that condition or warranty is limited to the Supplier doing any of the following (at its election):
(i) In case of goods, any one of the following as determined by the Supplier:
(i) The replacement of the goods or the supply of equivalent goods;
(ii) The repair of goods;
(iii) The payment of the cost of replacing the goods or of acquiring equivalent goods; or
(iv) The payment of the cost of having the goods repaired.
(ii) In the case of services, any one of the following as determined by the Supplier:
(i) The supply of the services again: or
(ii) The payment of the cost of having the Supplier’s services supplied again.
Acceptance and Returns
In order to determine the cause of the claimed defects, we would obviously require all the faulty items to be returned to PVI for testing. However as we feel that in practice, this may not be suitable. We therefore plan to maintain limited stocks in our warehouses in order to provide a more immediate service returns. These service returns will not be subject to our prior inspection of the faulty goods, and will be automatically available for all claims of defects.
(a) Any claim for non-delivery, shortage in supply, damage occurring during the course of delivery, or for rejects by the Customer, must be in writing and given to the Manager of the Supplier within 7 days of the Customer receiving the goods.
(b) All goods returned will not be considered for warranty replacement or credit refund until they are processed and accepted by the Supplier.
(c) Acceptance of goods will not necessarily entitle the Customer to a credit.
Damaged and Missing Products
All items are packaged securely to arrive safely at your door. Inspect upon arrival, open all boxes and check for damage or missing parts, and refuse to sign if damaged. Do not sign without inspection. Concealed damage must be reported within 24 hours. The shipper is not responsible for damage after 24 hours. We strive to ensure that all orders are shipped correctly. If you find damage or missing parts, please notify us immediately upon receipt of goods.
